The draft Directive on collective rights management and online multi-territory licensing of musical rights was published on 11 July.

Part of the Commission’s May 2011 Communication ‘A Single Market for Intellectual Property Rights’, the draft Directive’s twin aims are to improve the governance and transparency standards of collecting societies generally and to facilitate licensing of online music across the EU in particular.

If enacted, among its modernisation measures the Directive would impose minimum European quality standards on collecting societies that offer online service providers – including those providing streaming or access to films and games with music – multi-territory licenses for authors’ rights in musical works across the EU.

The draft Directive’s rules on better governance and greater transparency would affect collective rights management in all sectors, while specific provisions – for example, the “no territorial lock-in” safeguard in Article 30 – reflect EU law on measures segmenting the Internal Market.

Maria Martin-Prat has very kindly agreed to participate in the first ‘Chatham House’ rule discussion since publication of the draft Directive, one of several EU measures aimed at improving access to pan-EU digital content.
